If you are going to take into consideration the consumer Credit Act of 1974, you will see that every credit agreement must definitely contain certain criteria. However if you are going to have a look at the majority (75%) of the agreements don’t respect those criteria. This way your credit agreement might become unenforceable which will lead to the fact that you no longer have to pay your credit card debt.
Some credit agreements do have certain requirements missing, and this way they are becoming unenforceable. While some of them will only have parts missing and these can also be enforced, but this can be done only by a court. Most of the creditors will not go to court with these agreements, since a judge could easily say that they are not complying with the Consumer Credit Act 1974. So what they are doing is to sell the debt to a debt collection company.
This method of wiping out your credit card debt is AVAILABLE ONLY IN THE UK. These credit card companies are not aware of the fact that they are using enforceable contracts until we are going to tell them. And from that moment on the credit card company will have just two options left:
- To erase all your debt, so that you no longer have to pay any money
- Or to go to court with you and pay other expenses too.
So in case you would want to have your credit card debt erased, make sure that you read the Consumer Credit Act 1974 (some people refer to this as CCA1974).
